Do I need to conduct a re-draw to award unclaimed prizes? If so, when do I need to conduct the re-draw?

NATIONAL

An unclaimed prize draw is mandatory for any promotion. You must provide the original draw winner a reasonable time to claim the prize before you hold the redraw.

The unclaimed prize draw must be held at least one (1) month after the original draw.

Event Prizes - Exception: The exception is event prizes which fall within a month of the redraw, in which case the redraw may be held earlier. E.g. if you awarded tickets to the Australian Open and this started on 20 Jan, and the original draw was held on 14 Jan, you may hold the redraw before 20 Jan. We recommend holding the redraw midway between the original draw date and when the prize must be taken.

Instant Win Prizes - Exception: We are normally able to lodge a waiver to exclude any un-won or unclaimed instant win prizes valued at $100 or less from the redraw; if awarded in high quantities. The various lottery authorities tend to allow a waiver in such instance due to the administrative burden attached to awarding a high volume of low value prizes in a redraw.

NSW

A redraw is legally required in NSW, but this may be held 1 month after the original draw. Same exceptions apply as per the national requirements above.

VIC

No specific requirement for a re-draw in VIC.

Promoter must take “reasonable efforts” to award the prize. Otherwise, prize may be disposed of in accordance with any provisions in the Terms & Conditions (e.g. to another randomly drawn entry).

ACT

A redraw is mandatory in ACT.

If a prize is unclaimed after a reasonable period, unclaimed prize draw is required. The ACT department is accepting the redraw date as 1 month after the original draw. Same exceptions apply as per above.

SA

An unclaimed prize draw is mandatory in SA.

The unclaimed prize draw must be held at least 1 month after the original draw.

NT

If interstate, then refer to requirement of the State that has jurisdiction (i.e., where the draw takes place).

If NT only, then if a prize is unclaimed after 3 months, it must be surrendered to the Director of Licensing.

QLD

Re-draw mandatory, may be held 1 month after original draw.

Under QLD law, if a prize is unclaimed after 3 months, an unclaimed prize draw is required. However, the Terms & Conditions can specify that the unclaimed prize draw will take place sooner than 3 months.

WA

Unclaimed prize draw is recommended, but not required
