Each state in Australia has restrictions on prizes you are allowed to award in trade promotions. Please see a list of these below.

NB: The following restrictions do not apply to a game of skill promotion.

NSW

  • Vaping products (new restriction)

  • Volume of more than 5 litres of liquor with an alcohol content exceeding 20% by volume or Volume of more than 20 litres of liquor with an alcohol content less than 20% by volume;

  • Alcohol to be consumed on premise;

  • Tobacco products;

  • Firearms, ammunition & weapons

  • Cosmetic surgery

VIC

Lottery must not be offensive or against public interest, and therefore prizes that could be seen as such may be prohibited.

Tickets to declared events must be approved by Sports Minister.

ACT

  • Tobacco products

  • Where alcohol is promoted or included in a prize:

· Must include responsible drinking clause incl. NHMRC guidelines;

· Must be 18 years to enter;

SA

  • tobacco products,

  • firearms, antique firearms, ammunition,

  • dangerous articles and prohibited weapons,

  • cosmetic surgery (or similar medical/surgical procedures),

  • any goods or services the sale of which in SA would be an offence

NT

  • Alcohol may not form the principal part (£ 1/3 prize value) of any prize

  • Firearms, weapons, ammunition, explosives and tobacco also cannot be awarded as prizes.

QLD

  • Tobacco products;

  • Surgery,

  • Weapons & ammunition;

  • Any item the sale or acquisition of which is restricted by legislation

In Brisbane City Council area, alcohol prizes must be awarded for consumption off-premise (e.g., case of beer/wine), not on-premise

WA

Cosmetic and surgical procedures
