Permits are required for any trade promotion that is qualified as a Game of Chance.
NATIONAL
For a national promotion, permits may be required in NSW, ACT, SA and NT (if permit not issued elsewhere).
See below for requirements for obtaining a permit in NSW, ACT and SA.
NSW
NSW Authority required when the total Prize Pool is above $10,000
NB: A NSW notification must also be lodged for any promotion meeting the above requirement.
VIC
No (effective from 21 June 2015)
ACT
Yes, if total prize pool is GREATER THAN $3,000.
Considerations: Promotions that offer different prizes in each draw with no major prize draw at the end of the promotion are considered separate promotions. If each draw’s prize pool is $3,000 or less, no ACT permit is required for the promotion. If any draw’s total prize pool is over $3,000, then an ACT permit is required for that draw*. This excludes promotions with multiple draws having the same prize in each draw (e.g. promotions with weekly draws/monthly draws offering the same prize in each week/month).
*One set of terms can be drafted if there is only 1 draw that meets this requirement. Otherwise, separate terms may be required.
SA
If total prize pool is GREATER THAN $5,000 OR
if promotion includes a manual instant win element (i.e. scratch and win cards)
NB: If online scratch and win, then SA does not class this as a scratch and win promotion, and a permit will only be required in SA if the total prize pool is over $5,000.
NT
If total prize pool is GREATER than $5,000 AND no other permit is obtained.
E.g. if obtain a permit in NSW to run a promotion, then no permit is required in NT.
QLD
No
WA
No, but strictly speaking the Terms and Conditions should be provided to the WA lottery department and published on the promotional entry form or in a WA newspaper.
In our experience, however, the WA lottery department are not strictly enforcing these requirements.
