The award of a gift to the first 'X' number of claims is a limited offer and may require permits depending on the State and total gift pool, as outlined below.

NB: If the gift is provided at the point of purchase (while stocks last), it is arguable that the mechanic is a ''guaranteed'' offer as long as all offer advertising is removed from the store as soon as all gifts in the store are redeemed. In this case, we can argue no permits are required even though technically there is a cap on the number of gifts in store.

NATIONAL
For a national limited offer, permits may be required in NSW and ACT, depending on gift pool and claim mechanic in ACT (as outlined below).

NSW Authority required when the total gift pool is above $10,000

NB: A NSW notification must also be lodged for any promotion meeting the above requirement.

ACT
Yes, if the total prize pool is GREATER THAN $3,000 AND there is chance involved in the ordering of claims.

  • Mail claims = chance (as you may receive multiple letters at the one time, and you won't be able to tell which arrived first) = ACT permit required;

  • Online claims = NO chance (as you are able to pinpoint when a claim is received) = ACT permit NOT required

SA

A permit is no longer required to conduct a limited offer in SA. The SA lottery department confirmed this change to our office on 23 February 2021.

QLD/VIC/WA/TAS/NT
No permit required.
